Federal Legislative Authority in Relation to Oil and Gas Development in Canada

This report examines the distribution of legislative authority between the federal and provincial governments of Canada regarding the regulation of oil and gas development, detailing the specific jurisdictional powers the federal government can exercise.

• Oil and gas development in Canada is not solely under provincial authority; the federal government can regulate specific aspects of the industry that engage federal legislative powers as defined by the Constitution. Such regulation must focus on matters within federal jurisdiction, even if there are incidental effects on provincial matters.
• Federal legislative authority over oil and gas development is exercised both directly and indirectly across more than twelve areas of jurisdiction. Direct authority includes development on Indigenous reserves, offshore, and federal lands, as well as international and interprovincial export and transport.
