World Trade Organization Talks on Subsidies that Contribute to Overcapacity and Overfishing: What's on the table?

This report provides an overview of ongoing World Trade Organization (WTO) negotiations to establish additional global disciplines on subsidies that contribute to overfishing and overcapacity, building upon the 2022 Agreement on Fisheries Subsidies.

• Following the adoption of the Agreement on Fisheries Subsidies in June 2022 at the 12th Ministerial Conference, WTO members are negotiating broader rules to prevent government financial support from creating excessive fishing pressure and to protect marine resources, food security, and livelihoods.
• The current basis for negotiations is a draft text circulated to WTO members on April 12, 2024, by Ambassador Gunnarsson of Iceland, the chair of the Rules Negotiating Group.
• The 2022 Agreement on Fisheries Subsidies created a legally binding framework prohibiting subsidies for fishing of overfished stocks, subsidies to vessels on unregulated high seas, and subsidies for illegal, unreported and unregulated (IUU) fishing.
• The 2022 agreement requires countries to show "due restraint" when providing subsidies to vessels that fish stocks with unknown status or those that do not fly the providing country's flag.
