Joint Statement: Minister of Finance applies to intervene in SRD court case

A joint statement by the Institute for Economic Justice and #PayTheGrants regarding the Minister of Finance's application to intervene as a respondent in a court case concerning the Social Relief of Distress (SRD) grant.

• The Institute for Economic Justice and #PayTheGrants initiated legal action in July against the South African Social Security Agency and the Department of Social Development to address the unlawful exclusion of millions from the Social Relief of Distress (SRD) grant and the grant's decreased real value due to inflation since 2020.
• The Minister of Finance has applied to intervene in the litigation as a respondent, which the applicants interpret as an attempt to oppose the extension of the grant to rightful beneficiaries, including an estimated 50% of eligible people currently prevented from accessing it.
• The applicants have consented to the Minister's intervention, with a deadline for the Minister to file full answering papers set for 24 November. This follows a failure by the Department of Social Development and SASSA to meet a replying affidavit deadline in early September.
• The applicants argue that the government has a Constitutional obligation to provide basic rights, such as social assistance and adequate food, and assert that resources exist to both improve and extend the SRD grant, which is the sole social assistance for working-age able-bodied adults.
