Nouvelle version du traité contraignant de l’ONU a « perdu son âme »

Friends of the Earth International and member organizations of the Global Campaign express concern that the August 6, 2020, draft of the UN legally binding instrument to regulate transnational corporations (TNCs) in human rights has "lost its soul" by diluting its transnational scope and omitting key protections.

• The Global Campaign argues that the new draft of the treaty fails to meet the objectives of UN Human Rights Council resolution 26/9 because it extends its scope to all companies indiscriminately, rather than focusing specifically on those with transnational activities.
• The document identifies several critical omissions in the draft treaty, including the lack of recognition of TNC obligations regarding human rights, the absence of references to global value chains, the lack of an international court to sanction non-compliance, and the failure to establish the primacy of international human rights law over trade and investment agreements.
• The draft is criticized for failing to address the power imbalance between large TNCs and states, particularly in the Global South, and for weakening the joint and several liability of companies within a value chain and the responsibility of parent or controlling companies.
• The Global Campaign asserts that the Covid-19 pandemic creates barriers to the participation of civil society and affected communities, especially in the Global South, and therefore argues that the sixth session of the working group should not be a negotiation session but rather a period of consultation.
