A statement by Friends of the Earth International and over 600 civil society organizations calling for the suspension and termination of the Investor-State Dispute Settlement (ISDS) system to prevent corporations from suing governments over public health measures taken during the COVID-19 pandemic.

• The Investor-State Dispute Settlement (ISDS) system, found in various trade treaties, allows foreign companies to sue governments in arbitration for measures that allegedly impact their profits, potentially forcing governments to reverse public interest measures or pay millions in compensation.
• Government responses to the COVID-19 pandemic—including debt restructuring, making tests and medicines affordable, the use of private hospitals, and mandatory business closures—could trigger ISDS cases.
• More than 600 civil society organizations globally are demanding three specific actions: the suspension of all current ISDS cases during the COVID crisis, the termination of trade treaties containing ISDS clauses, and the suspension of any future agreements that include the ISDS system.
