Farm Bill Legislative Side-By-Side

This fact sheet provides a legislative side-by-side comparison of the Advanced Biofuel Payment Program under current law and the House Agriculture Committee's amended text from May 2024, noting that Senate text is pending.

• The Advanced Biofuel Payment Program, managed by USDA Rural Development, provides payments to entities producing finished advanced biofuels. These biofuels must be derived from renewable biomass feedstocks that are not food-based, specifically excluding corn, and are intended to reduce greenhouse gas emissions by at least 50 percent compared to fossil fuels.
• Under the 2018 Farm Bill, the program was authorized for mandatory annual funding of $7 million and discretionary annual funding of $20 million through fiscal year (FY) 2023. While mandatory funding continued through FY 2024, no discretionary funding was provided by Congress in FY 2023 or FY 2024.
• The House Agriculture Committee's amended text from May 2024 proposes extending the program's funding timeline. Specifically, it suggests extending both the $7 million mandatory funding and the $20 million discretionary funding authorizations from fiscal year 2023 to fiscal year 2029.
• Current law establishes specific constraints on payment distribution: the Secretary must limit payments to single producers to ensure equitable distribution, and payments for biofuels derived from a single eligible commodity (including its intermediate ingredients) cannot exceed one-third of the total available funds in a fiscal year. Additionally, facilities with a refining capacity over 150,000,000 gallons per year are limited to receiving no more than 5 percent of the annual funds.
