NOTICE BY COAL RIVER MOUNTAIN WATCH, ET AL. OF INTENT TO MOVE TO LIFT THE STAY OF THIS ACTION

This legal notice, filed by Coal River Mountain Watch and other plaintiffs, informs the United States District Court for the District of Columbia of their intent to move to lift a stay on consolidated cases challenging the 2008 SBZ Rule regarding stream buffer zones in coal mining.

• The litigation concerns the "2008 SBZ Rule," formally titled "Excess Spoil, Coal Mine Waste, and Buffers for Perennial and Intermittent Streams," promulgated by the Office of Surface Mining Reclamation and Enforcement (OSM) of the U.S. Department of the Interior and concurred in by the EPA.
• Plaintiffs, including Coal River Mountain Watch and the National Parks Conservation Association, seek the vacatur of the 2008 SBZ Rule based on claims under the Surface Mining Control and Reclamation Act of 1977, the Administrative Procedure Act, the National Environmental Policy Act, and the Endangered Species Act.
• A settlement agreement between the Plaintiffs and Federal Defendants allowed for a stay of judicial proceedings provided that OSM signed a proposed rule to amend or replace the 2008 SBZ Rule by February 28, 2011, and a final action by June 29, 2012; however, OSM has not signed either a proposed or final rule.
• Following unsuccessful discussions since July 2012 to resolve the claims, Coal River Mountain Watch and other plaintiffs intend to move the Court to lift the stay of the case on February 25, 2013.
