Monitoring the Health of the Sierra Nevada

Earthjustice challenged a December 2007 amendment by the Forest Service regarding the monitoring of management indicator species (MIS) in the Sierra Nevada mountain range, arguing that the changes increased risks to wildlife and habitat by reducing monitoring requirements.

• The Forest Service amended forest plans for all ten national forests in the Sierra Nevada mountain range in December 2007. This amendment reduced the number of management indicator species (MIS) being monitored and limited monitoring to the forest planning level, which Earthjustice argued would exclude site-specific projects and increase risks from logging and other destructive activities.
• Earthjustice contended that the December 2007 amendment would have significant environmental impacts by allowing stalled logging projects to proceed and terminating monitoring requirements meant to ensure the viability of key species. Furthermore, the amendment failed to define the duration, extent, or frequency of monitoring or provide mitigation measures for adverse effects on MIS.
• In September 2008, Earthjustice filed a legal challenge against the amendment, alleging violations of the Endangered Species Act and the National Environmental Policy Act. Although a district court initially ruled in favor of the Forest Service in August 2009, the parties eventually reached a settlement following an appeal by Earthjustice.
