Parents have a right to know: New York Pending Bill Aims to Prevent Childhood Lead Exposure and Close Regulatory Loophole

A statement by the Learning Disabilities Association of New York (LDA) advocating for New York bills S2353 and A4820, which would mandate lead testing in pre-1978 housing to close a regulatory gap in disclosure laws.

• Current federal and state laws require sellers to disclose lead-based paint only if they are aware of it, but they do not mandate the testing necessary to uncover such hazards. This gap results in properties being sold or rented without the disclosure of lead-based paint hazards.
• Proposed New York bills S2353 (Kavanagh) and A4820 (Rivera) aim to protect millions of New Yorkers by requiring lead testing for housing built before 1978.
• Lead poisoning is described as 100% preventable, yet it causes irreversible health and cognitive damage. Young children are especially vulnerable, absorbing 4–5 times more ingested lead than adults. Effects include learning disabilities, behavioral problems, slowed growth, and links to juvenile incarceration and school dropout rates.
