PROPOSED REVISIONS TO THE UNCITRAL RULES FOR INVESTOR-STATE ARBITRATIONS

A statement by the Center for International Environmental Law (CIEL) and the International Institute for Sustainable Development (IISD) proposing specific amendments to the UNCITRAL Arbitration Rules to increase transparency and public participation in investor-State arbitrations.

• CIEL and IISD propose a limited set of additions to the UNCITRAL Arbitration Rules specifically for investor-State arbitrations—defined as those brought by an investor against a State under treaty terms—to address public interest without affecting other types of arbitrations.
• The proposal advocates for the public disclosure of the initiation and results of investor-State arbitrations. This would be achieved by requiring tribunals to send the notice of arbitration, the composition of the tribunal, and all final awards, orders, or decisions to the UNCITRAL secretariat for posting on its website.
• To ensure citizens understand the stakes of these disputes, the authors propose that pleadings be disclosed and hearings be open to the public (via in-person attendance, closed-circuit TV, or web casting), while allowing for the redaction of privileged or proprietary information.
• The proposal suggests granting the public the right to petition the tribunal to file amicus curiae briefs. The tribunal would decide whether to allow these submissions based on whether they provide a particular perspective, knowledge, or insight and address a matter within the scope of the dispute.
