The State Of Trade Law And The Environment: Key Issues For The Next Decade

This working paper, produced by the International Institute for Sustainable Development (IISD) and the Center for International Environmental Law (CIEL), outlines a project to establish an objective baseline of current trade law as it relates to key environmental issues. The initiative aims to provide a consistent platform for negotiators and civil society to distinguish between the current state of the law and how it should be shaped during the Doha Round of trade negotiations.

• The International Institute for Sustainable Development (IISD) and the Center for International Environmental Law (CIEL) are collaborating to determine the current state of trade law regarding key environmental issues, using WTO Agreements and Dispute Settlement decisions as the basis. This effort is intended to create a consistent baseline for negotiators, observers, and civil society groups to facilitate meaningful dialogue on how the law should evolve.
• The project seeks to separate the factual state of existing law from normative debates over what the law should be, which the authors argue is necessary to better understand priorities, measure progress or regress, and assess results within the Doha Ministerial negotiations.
