The Downing Report was only partially disclosed, failing to respect the cultural norms of the Pehuenche communities.
• The Fundación Pehuen, established for social mitigation, has been criticized for being used to pressure Pehuenche people to leave their land to facilitate the Ralco project. The CAO notes persistent confusion regarding the foundation's governance, funding, and its role in supporting communities affected by Ralco rather than just Pangue.
• The IFC exited the project in July 2002 by liquidating its shares, but the CAO found that the IFC did not independently verify if social obligations—specifically those regarding the families of El Avellano—had been met before its withdrawal. Consequently, these families feel abandoned and are in a disadvantaged negotiating position with Pangue S.A.
• The CAO concludes that the IFC failed to ensure a fully cumulative environmental and social impact assessment for the Pangue and Ralco projects. Although the IFC viewed them as separate, the CAO argues they are physically and operationally linked, and the IFC's failure to disclose its concerns during the Ralco EIA process hindered full consultation.
• There are significant concerns regarding dam safety and emergency response. The IFC did not possess a copy of an emergency response plan for Pangue, as it was not required in the 1993 investment agreement. The CAO recommends that the IFC urge Pangue S.A. to disclose and consult on these plans, especially given the region's seismic and volcanic activity.
• The CAO recommends that the IFC strengthen its due diligence of sponsors to include their environmental and social track records, including those of parent companies and subsidiaries, to ensure they share the IFC's values before entering into equity investments.
