STATEMENT OF CARROLL MUFFETT PRESIDENT AND CEO CENTER FOR INTERNATIONAL ENVIRONMENTAL LAW (CIEL) ON BEHALF OF CIEL, FRIENDS OF THE EARTH AND SIERRA CLUB AS DELIVERED TO THE HOUSE ENERGY AND COMMERCE COMMITTEE SUBCOMMITEE ON MANUFACTURING COMMERCE AND TRADE

Carroll Muffett, President and CEO of the Center for International Environmental Law (CIEL), testified before the House Energy and Commerce Committee on July 24, 2013, regarding the Transatlantic Trade and Investment Partnership (TTIP). Representing CIEL, Friends of the Earth, and the Sierra Club, Muffett argued that the U.S. chemical regulation system is inadequate and that TTIP risks weakening existing environmental and health standards in the EU and U.S. states rather than improving them.

• The current chemical regulation system in the United States is insufficient for the modern chemicals economy, contributing to rising rates of cancer and adverse health effects among Americans, as well as some of the highest levels of synthetic chemicals in human bodies globally.
• There is a significant risk that the Transatlantic Trade and Investment Partnership (TTIP) will be used to lower the stronger chemical standards currently in place in the European Union and certain U.S. states, rather than raising U.S. standards to provide better protection.
• To protect public health and the environment, TTIP must avoid provisions that dilute new health rules, include mutual recognition for the chemicals sector that reduces domestic regulatory control, or prioritize corporate interests via investor-state dispute resolution.
• TTIP should not prevent state, local, or foreign governments from adopting new initiatives to combat toxic chemicals, nor should it hinder regulation of emerging threats such as hydraulic fracturing, endocrine disrupting chemicals, or nanotechnologies.
• Recent U.S. trade negotiations have been characterized by a lack of transparency and secrecy that is inconsistent with the principles of a constitutional democracy and the public's right to participate in policy dialogue.
