A statement by the Center for International Environmental Law (CIEL) regarding the Special Rapporteur's report on business, planetary boundaries, and the right to a clean, healthy, and sustainable environment, emphasizing the need for mandatory corporate due diligence and the phase-out of fossil fuels.

• The Center for International Environmental Law supports the Special Rapporteur's recommendations that States implement mandatory human rights and environmental due diligence legislation covering corporate operations, subsidiaries, and value chains. It also advocates for improved public access to information, justice, effective remedy, and public participation, specifically including the Free and Prior Consent of Indigenous Peoples.
• Oil, gas, and coal are identified as the primary drivers of the triple planetary crisis. To address this, States are urged to phase out fossil fuels and their associated subsidies, reject unproven technologies in the transition to renewable energy, and combat corporate greenwashing, lobbying, and misinformation.
• Investor-state dispute settlement (ISDS) mechanisms within international investment contracts and agreements are described as significant barriers to environmental and climate action, leading to a call for their elimination from international trade and investment treaties.
• The right to a clean, healthy, and sustainable environment should be integrated into national laws and international human rights and environmental processes, including the proposed legally binding instrument on business and human rights.
