European Communities – Measures Affecting the Approval and Marketing of Biotech Products (WT/DS/291, 292, and 293)

A coalition of environmental and agricultural NGOs requested that the WTO Panel accept an amicus curiae brief to provide technical and legal expertise on the uncertainties of genetically modified organisms (GMOs) and the application of the precautionary principle under the SPS Agreement.

• The applicants seek to provide the Panel with expert technical, scientific, and legal information concerning the uncertainties associated with GMOs, specifically regarding their effects on host organisms and the inability of scientists to predict impacts on human, animal, and plant health.
• The proposed amicus brief intends to analyze the role of scientific uncertainty in the interpretation of Article 5.7 of the WTO Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement) and the application of the precautionary principle in international law.
