Transformer l’essai de Paris : lutter contre le changement climatique tout en protégeant les droits

This report provides recommendations for integrating human rights, social, and environmental principles into the implementation modalities of the Paris Agreement. It argues that climate action must be combined with existing international obligations to ensure a just transition, protect vulnerable populations, and maintain ecosystem integrity.

• The Paris Agreement's preamble explicitly requires Parties to respect, promote, and consider their human rights obligations when taking climate action. This includes specific protections for disproportionately affected groups such as indigenous peoples, women, migrants, children, and persons with disabilities.
• Climate mitigation and adaptation strategies can inadvertently violate human rights if they lack consultation or fail to consider social and environmental impacts. Examples include forced displacements caused by renewable energy projects or the negative impacts of large hydroelectric dams and biofuel plantations on local populations.
• Indigenous peoples, who represent 5% of the global population but 15% of the poorest, are critical actors in climate solutions. They manage 80% of global biodiversity resources and contribute to ecosystem conservation through traditional knowledge and innovation.
• Gender inequality in access to education, resources, and decision-making means women and girls are disproportionately affected by climate change. Effective climate policies must integrate gender-sensitive approaches to ensure the rights of women are protected and their innovative solutions are utilized.
• Food security is threatened by climate change, which impacts all aspects of food systems beyond just production. Small-scale food producers, particularly women, often lack secure land tenure and access to climate information, making them highly vulnerable.
• A 'just transition' is necessary to protect workers whose jobs and livelihoods are at risk due to climate policies. This involves integrating labor market impact assessments and support measures into National Determined Contributions (NDCs) and the Global Stocktake.
• Maintaining ecosystem integrity is essential for long-term climate effectiveness, as balanced ecosystems store carbon and provide natural barriers against floods and rising waters. Poorly planned bioenergy or hydropower projects have already led to biodiversity loss and ecosystem degradation.
• The report recommends that four key implementation mechanisms of the Paris Agreement be reformed: NDCs should be participatory and include human rights safeguards; adaptation communications must prioritize vulnerable groups; the transparency framework should track human rights obligations; and the Global Stocktake should evaluate climate action qualitatively against the principles in the preamble.
