Opposition to the inclusion of investor-state dispute settlement in the Trans-Atlantic Trade and Investment Partnership

• ISDS enables foreign corporations to use private trade tribunals to challenge government actions they claim decrease investment value, including demanding compensation for a lack of a ‘predictable regulatory environment’ even when policies apply to both domestic and foreign investors.
• The application of ISDS has grown significantly, with corporations filing more than 500 cases against 95 governments via bilateral investment treaties and free trade agreements, often targeting environmental and public interest policies.
