Letter to Ms. Harrison pursuant to USTR documents under FOIA

A December 2003 letter from Friends of the Earth – U.S., on behalf of several environmental organizations, requesting investment-related documents from the United States Trade Representative (USTR) under the Freedom of Information Act (FOIA).

• Friends of the Earth – U.S., representing itself, the Center for International Environmental Law, Natural Resources Defense Council, and Defenders of Wildlife, requested all investment chapters, negotiating proposals, and consolidated draft texts for bilateral or regional free trade agreements negotiated by the United States since the start of 2003.
• The FOIA request specifically identifies several trade agreements of interest, including those with Australia, Morocco, the Southern African Customs Union, Central America, and Andean countries such as Colombia and Peru.
• The requesting organizations sought not only the primary texts but also all complementary materials, such as side letters, memoranda of understanding, annexes, and schedules that form an integral part of the investment provisions.
• The applicants requested a fee waiver on the basis that the disclosure of these documents would significantly enhance public understanding of the agreements' public policy implications and aligns with the public interest missions of the involved non-profit organizations.
