Ciel questions President of Inter-American Development Bank over systematic problems with the structure and procedures of the Independent Investigation Mechanism

The Center for International Environmental Law (CIEL) sent a letter to the President of the Inter-American Development Bank (IDB) on February 21, 2003, arguing that the Independent Investigation Mechanism (IIM) suffers from systemic structural and procedural failures. Using the Yacyreta, Cañabrava, and Termoeléctrica del Golfo cases as evidence, CIEL highlights issues with transparency, unpredictable timelines, and inadequate remedies, urging the IDB to implement fundamental reforms based on the models of other multilateral development banks.

• CIEL identifies three core requirements for an effective Independent Investigation Mechanism (IIM): strict and clear timelines with uninterrupted information flow to claimants and effective remedies; independence from IDB management and legal counsel regarding complaint eligibility to avoid conflicts of interest; and an independent, permanent secretariat with sufficient funding.
• Current cases before the IIM demonstrate systemic failures in transparency, timing, and remedy effectiveness. In the Termoeléctrica del Golfo case, claimants lacked adequate status information, and the terms of reference and the consultant's report were not made public. In the same case, nearly two years passed between the August 11, 2000 request and the authorization of an investigation. In the Cañabrava case, the IIM had not officially confirmed receipt of an investigation request after more than a year, and the Yacyreta case showed that the first IIM investigation failed to remedy problems on the ground.
• A comparison between the IDB's IIM and the World Bank's (IBRD) Inspection Panel regarding the Yacyreta case reveals significant delays in the IDB's process. While both received the request on May 17, 2002, the IBRD Inspection Panel registered the complaint by May 30, 2002, visited the project site and interviewed the Project Host Country's Executive Director in July 2002, and had the Board approve an investigation by September 9, 2002. In contrast, the IDB had not provided public notice of the complaint or a process timeline.
• CIEL recommends that the IDB take two primary steps: commit to processing existing claims by releasing a schedule with clear deadlines, and fundamentally reform the IIM through a transparent, inclusive, and participatory process that includes consultations on appropriate structures.
