This briefing document is a recommendation to the Deputy Director-General of the Department of Mineral Resources and Energy to approve amendments to mining rights held by Mineral Sands Resources (Pty) Ltd and Tormin Mineral Sands (Pty) Ltd. The proposed changes include adding magnetite as a mineable mineral and extending the mining area for Mineral Sands Resources (Pty) Ltd in the Magisterial District of Van Rhynsdorp.

• Mineral Sands Resources (Pty) Ltd and Tormin Sands (Pty) Ltd were issued renewed mining rights on 19 September 2019 for a period of 10 years, expiring on 22 August 2029. These rights allow for the mining of Zircon (Gemstone), Ilmenite (Heavy Mineral), Garnet, Leucoxene, and Rutile (Heavy Minerals).
• An application was made on 26 April 2017 under section 102 of the Mineral and Petroleum Resources Development Act, 2002 to add magnetite to both mining rights and to extend the mining area of Mineral Sands Resources (Pty) Ltd (right 10108 MR). The requested extension includes 43.7 hectares between the high and low water marks adjacent to farms Graauwduinen 152, Remainder of Waterbak, and portions of Klipviey Karoo Kop 153, as well as 75 hectares of strand line area on farm Geelwal Karoo 262.
• The Mine Economics department estimated the life of the mine for the combined existing and extension areas to be approximately eight years. Additionally, a financial provision of R15,200,000.00 was submitted on 10 May 2019.
• Following the granting of the Environmental Impact Assessment (EIA) and Environmental Management Programme (EMPr) on 07 June 2019, four appeals were filed by the Centre for Environmental Rights, North Western Cape Mining Forum, Raakvat Boerdery, and Merie sowman. The Minister of Forestry, Fisheries and the Environment dismissed the appeals of the first, second, and fourth appellants, while upholding the appeal of the third appellant (except regarding map accuracy), resulting in an addendum to the EIA signed on 27 May 2020.
