NEMA Section 24G Application to Rectify Unlawful Activities: Expansion of Processing Area and New Process Water Dam at the Tormin Mine, West Coast Environmental Management Programme

This document is an Environmental Management Programme (EMPr) prepared by SRK Consulting (South Africa) (Pty) Ltd for Mineral Sands Resources (Pty) Ltd (MSR). It is part of a Section 24G application under the National Environmental Management Act (NEMA) to rectify unlawful activities at the Tormin Mine, specifically the unauthorized expansion of a processing area and the construction of a process water dam.

• Mineral Sands Resources (Pty) Ltd (MSR) undertook two specific unlawful activities at the Tormin Mine that required rectification under NEMA Section 24G: the clearing of a 3.9 ha area for stockpiling adjacent to processing facilities and the construction of a 2.2 ha process water dam, which involved a total vegetation clearance of 4.1 ha.
• The new process water dam, located south-east of the processing area, has a storage capacity exceeding 50,000 m3 and a maximum wall height of approximately 7 m from toe to crest.
• The identified environmental impacts of the unlawful activities are categorized as follows: biodiversity impacts (loss of vegetation, species of conservation concern, and fauna habitat disturbance) are rated as 'Low (-ve)'; sense of place and heritage impacts are 'Very Low (-ve)'; groundwater contamination is 'Very Low (-ve)'; and socio-economic, pollution, and noise impacts are rated as 'Insignificant'.
• Operational phase mitigation measures include restricting vehicle speeds to 35 km/h in affected areas, maintaining a 'No Go' zone for undisturbed areas, and requiring that hazardous material storage facilities have a bund containment capacity of 110% of the largest container.
• The closure phase requirements include the preparation of a detailed Closure Plan approximately one year before planned closure, which must outline the removal of all infrastructure, ripping of disturbed footprints, redistribution of topsoil, and the capping and reseeding of the process water dam.
• The Department of Mineral Resources (DMR) refused an Environmental Authorisation (EA) for the extension of the Tormin Mine on 22 November 2017, stating that a section 24G process was necessary to rectify the unlawful activities.
