This affidavit, deposed by Dr Tsakanl Ngomane, Deputy Director-General for Climate Change, Air Quality and Sustainable Development, responds to a request from the Centre for Environmental Rights (CER) for access to greenhouse gas reporting records and pollution prevention plans under the Promotion of Access to Information Act, 2000.

• On 11 February 2019, the Centre for Environmental Rights (CER) submitted a request under the Promotion of Access to Information Act, 2000 (PAIA) for access to specific environmental data, including the database of data providers registered under Regulation 5 of the National Greenhouse Gas Emission Reporting Regulations (GN 275 of 2017) and the latest reports submitted under Regulation 7(1) of those regulations by several entities, including Eskom Holdings SOC Ltd, Sasol Ltd, and ArcelorMittal South Africa Ltd.
• The CER request also sought the database of persons who submitted pollution prevention plans under regulation 4(1) of the National Pollution Prevention Plan Regulations (GN 712 of 2017), the plans submitted up to 31 December 2020 under regulation 3(2) for specific companies, and the latest annual progress reports under regulation 5(1) of the PPP Regulations.
• The Department stated it is not in possession of, and therefore cannot provide, the annual progress reports requested under regulation 5(1) of the National Pollution Prevention Plan Regulations 2017 for several entities, specifically: Anglo American Plc, Petmin Ltd, Mbuyelo Coal Pty Ltd, Kuyasa Mining Pty Ltd, Gold Fields Ltd, Seriti Resources Holdings Pty Ltd, Glencore, and Exxaro Resources Ltd.
