This affidavit, deposed by Dr Tsakani Ngomane, Deputy Director-General for Climate Change, Air Quality and Sustainable Development, addresses a request from the Centre for Environmental Rights (CER) for access to greenhouse gas reporting records and pollution prevention plans under the Promotion of Access to Information Act, 2000.

• The Centre for Environmental Rights (CER) requested access to the database of data providers registered under Regulation 5 of the National Greenhouse Gas Emission Reporting Regulations (GN 275 of 2017), as well as specific reports submitted under Regulation 7(1) by various entities including Eskom, Sasol, and ArcelorMittal South Africa Ltd.
• The CER requested the database of persons who submitted pollution prevention plans under regulation 4(1) of the National Pollution Prevention Plan Regulations (GN 712 of 2017), as well as specific plans and annual progress reports for a list of companies for the period ending 31 December 2020.
• The Department is unable to provide reports submitted in terms of Regulation 7(1) for Petmin Ltd, Mbuyelo Pty Ltd, Kuyasa Pty Ltd, Exxaro Resources Ltd, and Gold Fields Ltd because the Department is not in possession of these records.
