The Centre for Environmental Rights, representing eight civil society organisations, has appealed the grant of a coal mining right to Atha-Africa Ventures (Pty) Ltd in the Mabola Protected Environment. The appellants request the suspension of the mining right and ask the Minister of Mineral Resources not to grant written permission for commercial mining under NEMPAA, arguing that the area's environmental sensitivity makes coal mining detrimental and that proper legal permissions were not obtained.

• On 1 April 2015, eight civil society and community organisations, represented by the Centre for Environmental Rights, appealed the granting of a mining right to Atha-Africa Ventures (Pty) Ltd for underground coal mining in the Mabola Protected Environment.
• The eight organisations filing the appeal are Earthlife Africa, Johannesburg, Birdlife South Africa, the Mining and Environmental Justice Community Network of South Africa, the Endangered Wildlife Trust, Federation for a Sustainable Environment, Bench Marks Fouridation, Association for Water and Rural Development (AWARD), and groundWork.
• The appellants seek to set aside the mining right in its entirety, citing vague and unlawful environmental conditions and the extreme environmental sensitivity of the area, which was declared a protected environment to prevent the risks and impacts of coal mining.
• A primary ground for the appeal is that the mining right was granted without the required written permission from the Minister of Environmental Affairs and the Minister of Mineral Resources under section 48(1)(b) of the National Environmental Management: Protected Areas Act (NEMPAA).
