A letter from the Centre for Environmental Rights (CER) to the Department of Environmental Affairs (DEA) requesting urgent information regarding a mining right granted to Atha-Africa Ventures (Pty) Ltd for the proposed Yzermyn Underground Coal Mine within the Mabola Protected Environment.

• The Mabola Protected Environment was declared in January 2014 by the Mpumalanga MEC under the National Environmental Management: Protected Areas Act (NEMPAA).
• Reports indicate that the Mpumalanga Regional Manager for the Department of Mineral Resources (DMR) granted a mining right to Atha-Africa Ventures (Pty) Ltd (AAV) for an area located within the Mabola Protected Environment, and that AAV intends to exercise these rights despite NEMPAA section 48 provisions.
• The CER requested information by 25 February 2015 regarding any notifications from the Mpumalanga MEC or the Mpumalanga Department of Agriculture, Rural Development, Land and Environmental Affairs concerning the potential withdrawal or exclusion of parts of the Mabola Protected Environment under section 29 of NEMPAA.
