LOCAL GOVERNMENT: MUNICIPAL PLANNING AND PERFORMANCE MANAGEMENT REGULATIONS, 2001

The Local Government: Municipal Planning and Performance Management Regulations, 2001, issued under the Municipal Systems Act 32 of 2000, establish the mandatory requirements for South African municipalities to develop Integrated Development Plans (IDPs) and implement performance management systems. The regulations detail the necessary components of an IDP, the process for its amendment, the setting and review of key performance indicators (KPIs), and the establishment of performance audit committees and community participation forums.

• A municipality's integrated development plan (IDP) must include specific elements: an institutional framework with an organogram for implementation and internal transformation, investment and development initiatives (including infrastructure, physical, social, economic, and institutional), all known projects and programs implemented by any organ of state, and the municipality's key performance indicators.
• The IDP must incorporate a financial plan and a spatial development framework. The financial plan must include budget projections, available resources for capital and operational expenditure, and strategies for revenue raising, asset management, and cost-effectiveness. The spatial development framework must align with neighboring municipalities, provide a visual representation of desired spatial form, and include a strategic environmental impact assessment.
• Amendments to an IDP can only be introduced by a member or committee of the municipal council and must be accompanied by a memorandum of reasons. Adoption requires reasonable notice to all council members and a public comment period of at least 21 days. District municipalities must consult local municipalities in their area, and local municipalities must consult their respective district municipality before finalizing amendments.
• Municipalities are required to establish a performance management system that defines the cycle of planning, monitoring, measurement, review, reporting, and improvement. This system must clarify the roles of all players, including the local community, and be adopted before or during the setting of key performance indicators (KPIs) and targets.
• The regulations prescribe several general key performance indicators (KPIs) that municipalities must track, including the percentage of households with access to basic water, sanitation, electricity, and solid waste removal; the percentage of households earning less than R1100 per month with access to free basic services; the number of jobs created via local economic development; and specific financial viability ratios for debt coverage, outstanding service debtors to revenue, and cost coverage.
• Performance targets must be set annually for each KPI and must be practical, realistic, and commensurate with the municipality's capacity and resources. Monitoring systems must report to the municipal council at least twice a year and be designed to detect under-performance early and provide corrective measures.
• Municipalities must implement internal auditing of performance measurements, which includes appointing a performance audit committee of at least three members annually. The majority of this committee cannot be municipal councillors or employees, and it must include at least one expert in performance management. The committee must submit audit reports to the municipal council at least twice a year.
• To ensure community participation, municipalities without an existing structure must establish a forum to assist in drafting and implementing the IDP and reviewing performance. The municipality must allow the local community at least 21 days to comment on the final draft of the IDP before it is submitted to the council for adoption.
