• To apply for the renewal of a mining right under Section 24(1), applicants must lodge their application at the office of the Regional Manager for the region where the land is located, follow the prescribed manner, and pay a non-refundable application fee.
• A renewal application must include specific documentation: the reasons and requested period for renewal, a detailed mining work programme for that period, and a report on compliance with the approved environmental management programme, including remaining rehabilitation needs and their estimated costs.
• The Minister is required to grant a mining right renewal if the applicant meets the procedural requirements and has complied with the mining work programme, the terms and conditions of the mining right (without contravening the Act or other laws), the prescribed social and labour plan, and the approved environmental management programme.
• Mining rights can be renewed for multiple periods, with each individual renewal period limited to a maximum of 30 years. A right remains in force after its expiry date if a renewal application has been lodged, until that application is either granted or refused.
• Applications for renewal must use Form E (Annexure I) and include full applicant particulars, a plan of the mining area per regulation 2(2), the specific minerals involved, the requested renewal period, reasons for renewal, a report on mining results and expenditure, and any other documentation requested by the Minister.
