REQUEST FOR WRITTEN REASONS: MINISTERIAL DETERMINATION ON THE PROCUREMENT OF NEW GENERATION CAPACITY FROM RENEWABLES, STORAGE, GAS AND COAL

The Centre for Environmental Rights, acting on behalf of groundWork, has submitted a formal request to the South African Minister of Mineral Resources and Energy for written reasons regarding a Ministerial determination published on 25 September 2020. The determination outlines the procurement of new generation capacity from renewables, storage, gas, and coal based on the Integrated Resource Plan for Electricity 2019–2030 (IRP 2019). The request specifically challenges the inclusion of new fossil fuel capacity and seeks justification for the timing and scale of these allocations.

• The Ministerial determination published on 25 September 2020 specifies the procurement of new generation capacity across four categories: 6,800 MW from renewable energy (PV and Wind) for 2022 to 2024; 513 MW from storage for 2022; 3,000 MW from gas for 2024 to 2027; and 1,500 MW from coal for 2023 to 2027.
• The Centre for Environmental Rights, representing groundWork, objects to the inclusion of new fossil fuel capacity (gas and coal) in the determination, arguing that such allocations cannot be legally justified and that the IRP 2019 does not constitute a valid basis for these decisions.
• The request for written reasons is made under section 5 of the Promotion of Administrative Justice Act, 2000 (PAJA), asserting that the Ministerial determination is an administrative action affecting the public, a position previously supported by a Western Cape High Court judgment.
• The Centre for Environmental Rights specifically seeks clarification on whether the 1,500 MW coal allocation includes capacity from two preferred bidder coal independent power producers: Thabametsi and Khanyisa.
