REQUEST FOR SUSPENSION OF THE DECISION OF THE MINISTER OF MINERAL RESOURCES AND ENERGY, OR A DELEGEE, TO GRANT AN AMENDMENT OF MINING RIGHT(S) IN RESPECT OF THE TORMIN MINE ON THE WEST COAST IN TERMS OF SECTION 102 OF THE MINERAL AND PETROLEUM RESOURCES DEVELOPMENT ACT

The Centre for Environmental Rights (CER) is requesting that the Minister of Mineral Resources and Energy delay a decision on a suspension application regarding the Tormin Mine. This request follows a reply from the mining right holders who argue that the CER's internal appeal is defective due to non-compliance with amended MPRDA regulations.

• The Centre for Environmental Rights (CER) lodged an internal appeal on 21 September 2020 under section 96(1) of the Mineral and Petroleum Resources Development Act (MPRDA), along with an application under section 96(2) to suspend the decision to grant an amendment of mining rights for the Tormin Mine.
• The right holders of the mining rights opposed the suspension application on 14 October 2020, claiming the internal appeal is defective because it did not comply with the amended Regulation 74 of the MPRDA regulations, which took effect on 27 March 2020.
• The CER maintains that there was 'sufficient substantial compliance' with Regulation 74 to make the appeal valid, but it intends to remedy any alleged procedural defects and seek condonation if necessary.
• The CER has requested that the Minister or delegee postpone the decision on the suspension application until the CER can deliver a response to the right holders' reply, which the CER undertakes to provide by 28 October 2020.
