Admission as amicus curiae in terms of Rule 16A of the Uniform Rules of Court in the matter of The Trustees for the Time Being of GroundWork Trust and Another v The Minister of Environmental Affairs & Four Others (NGHC case no 39724/19)

Lawyers for Human Rights requested consent for UN Special Rapporteur David Richard Boyd to act as amicus curiae in a South African court case (NGHC case no 39724/19). Boyd intended to provide international and comparative legal perspectives on State obligations regarding air pollution and the right to a healthy environment to assist the court in interpreting the NEM: Air Quality Act and the South African Constitution.

• Mr David Richard Boyd, the UN Special Rapporteur on Human Rights and the Environment, seeks admission as amicus curiae to provide the court with global expertise and perspective on the obligations of States to protect human rights from environmental harm, specifically air pollution.
• The proposed submissions from the Special Rapporteur will focus on international human rights law and comparative constitutional law. Specifically, they aim to provide a contextual overview of internationally guaranteed human rights and the impact of air pollution, outline State obligations under international law to inform the interpretation of the South African Constitution and the National Environmental Management (NEM): Air Quality Act 39 of 2004, and analyze how other States interpret the right to a healthy environment regarding air pollution.
• The Special Rapporteur's contribution is intended to assist the court in determining if the Minister has a legal duty to create regulations under the NEM: Air Quality Act to implement and enforce the Highveld Priority Area Air Quality Management Plan by examining South Africa's obligations under international law.
