The Minister of Environmental Affairs of South Africa dismissed an appeal lodged by the Centre for Environmental Rights and other organizations against the granting of an Environmental Authorisation (EA) to Kuyasa Mining (Pty) Ltd on behalf of KiPower (Pty) Ltd. The EA permitted the construction of a 600MW coal-fired independent power plant and associated infrastructure in the Victor Khanye Local Municipality, Mpumalanga Province.

• The proposed power plant is planned for location within 5km of the Delmas Coal mine and approximately 20km from Delmas, within the Victor Khanye Local Municipality. While the initial project is for 600MW, the Final Environmental Impact Report (FEIR) indicates a potential long-term expansion up to 2000MW.
• The Minister rejected the appellant's claim that the Department failed to comply with NEMA and the 2010 EIA Regulations, stating that the socio-economic and air quality impact assessments in the EIR were sufficient to address health concerns and that ambient air quality standards would not be exceeded.
• Regarding climate change, the Minister ruled that there is currently no legal basis within the EIA framework to require a specific climate change impact assessment, despite South Africa's adoption of the Paris Agreement in December 2015.
• The Minister stated that coal-fired power stations remain a necessary part of South Africa's energy mix to meet long-term electricity demand, though the Department remains committed to identifying cleaner technologies.
• The project is estimated to inject approximately R800-billion into the regional economy and create various employment opportunities.
