This document is an appeal filed on 17 January 2022 by Anchor Energy LNG Pty Ltd and Nseleni Power Corporation Pty Ltd against the Department of Forestry, Fisheries and the Environment's (DFFE) decision to refuse environmental authorisations for the Nseleni Independent Floating Power Plant (NIFPP) and an associated LNG receiving and storage facility at the Port of Richards Bay.

• The DFFE refused environmental authorisations for the NIFPP and the LNG facility on 15 November 2021, citing high negative impacts on the estuarine environment, specifically regarding macrobenthos and avifauna from a visual disturbance perspective.
• The Appellants argue that the DFFE applied a rigid and uncommunicated policy of not authorising any activities in 'high biodiversity sensitive areas', failing to distinguish between such areas and 'No Go' areas defined by the Environmental Assessment Practitioner (EAP).
• The DFFE claimed the application was deficient due to a lack of full avifaunal baseline data and the absence of a pre-monitoring programme. The Appellants contend that the EAP used a 'worst case scenario' to rank impacts as 'high' and proposed an adaptive management strategy to refine mitigation through monitoring.
• The Appellants are in a 'catch-22' situation regarding landowner consent: the DFFE requires written consent from the Transnet National Port Authority (TNPA) for the authorisation, but TNPA requires the environmental authorisation to be in place before granting the necessary licence/lease.
• The Appellants assert that the DFFE failed to consider the socio-economic benefits of the project, such as reducing load shedding and providing secure power, which they argue is a failure to apply the concept of sustainable development.
