MANUAL ISSUED IN TERMS OF SECTION 14 OF THE PROMOTION OF ACCESS TO INFORMATION ACT, 2000 (ACT NO 2 OF 2000)

This document is a PAIA Manual issued by the South African Department of Mineral Resources and Energy (DMRE). It provides a comprehensive guide for the public on how to exercise their constitutional right of access to information held by the Department, in accordance with the Promotion of Access to Information Act, 2000 (PAIA) and the Protection of Personal Information Act, 2013 (POPIA).

• The Department of Mineral Resources and Energy (DMRE) is mandated to develop a mineral resources and energy sector that promotes environmental sustainability, social equity, and economic growth and development. Its vision is to lead the transformation of South Africa through sustainable development and economic growth in the energy and mining sectors.
• The DMRE administers a wide range of legislation spanning from 1956 to 2008, including the Mines and Works Act, 1956; the Mineral and Petroleum Resources Development Act, 2002; the Electricity Regulation Act, 2006; and the National Energy Act, 2008.
• Certain records are automatically available for inspection and copying without a formal PAIA request, including published policies, guidelines, annual reports, strategic plans, budget speeches, and vacancy circulars. Many of these are accessible via the Department's website at www.dmre.gov.za.
• To request access to records, individuals must complete 'Form A' and submit it to the Chief Director: Legal Services. A request fee of R100.00 is required unless the requester is a personal requester or claims a fee exemption. Decisions on requests are typically made within 30 days, with a possible extension of another 30 days.
• Requesters who are denied access or are dissatisfied with fees or timelines have the right to lodge an internal appeal to the Minister of Mineral Resources and Energy within 60 days. If the internal appeal is unsuccessful, a complaint may be lodged with the Information Regulator within 180 days or an application may be made to a court.
• The Department processes personal information for employees, bidders, vendors, and applicants under mineral and energy legislation. This data is used for recruitment, payroll, verifying business relationships, and fulfilling statutory obligations. Information may be shared with entities such as the South African Police Services, the South African Revenue Services, and the Auditor-General.
