The Department of Forestry, Fisheries and the Environment of South Africa has refused an application for Environmental Authorisation submitted by Karpowership SA (Pty) Ltd for a 540MW Gas to Power Powership Project at the Port of Ngqura. The refusal is based on significant failures in the Environmental Impact Assessment (EIA) process, including inadequate public consultation, missing critical specialist studies on underwater noise, and gaps in the provided environmental assessments.

• The Competent Authority refused the application for Environmental Authorisation for the 540MW Gas to Power Powership Project at the Port of Ngqura within the Coega SEZ, Nelson Mandela Bay Metropolitan Municipality, Eastern Cape Province.
• The Environmental Impact Assessment (EIA) process was found to be compromised due to the applicant's failure to meet public consultation and information gathering requirements under Section 24(1A)(c) of NEMA. Specifically, the draft EIAr was available for public review for less than the required 30 days, and documents were removed from the website during the process.
• The Environmental Assessment Practitioner (EAP) failed to follow Regulation 23(1)(b) of the EIA Regulations, 2014, by submitting an EIAr containing significant new information and changes that had not been presented to interested and affected parties for consideration prior to the decision-making phase.
• The application lacked a necessary Underwater Noise Impact Assessment, despite recommendations from marine ecology and estuarine specialists. This omission left the Competent Authority unable to determine the impact on marine ecology and the African Penguin (Sphensiscus demersus) breeding on Jaheel and St Croix islands.
• The Competent Authority noted that the EAP failed to provide a clear and specific list of all applicable listed activities, despite multiple warnings. This uncertainty prevented the authority from making an informed decision on the potential impacts of the specified activities on the environment.
• Specialist studies were deemed inadequate due to limitations including insufficient time for analysis, failure to adhere to assessment standards, and conducting studies in the wrong season.
• The proposed project infrastructure included two floating mobile Powerships and a Floating Storage Regasification Unit (FSRU) with a design capacity of approximately 540MW, utilizing 27 gas reciprocating engines and 3 steam turbines.
