A letter from the South African Department of Environmental Affairs to the Centre for Environmental Rights (CER) regarding a request for access to information under the Promotion of Access to Information Act, 2000 (PAIA).

• The Centre for Environmental Rights (CER) requested several sets of records from the Department of Environmental Affairs on 11 February 2019, including databases of registered data providers under the National Greenhouse Gas Emission Reporting Regulations, reports from specific entities under Regulation 7(1) of those regulations, a list of persons who submitted pollution prevention plans under the National Pollution Prevention Plan Regulations (GN 712 of 2017), and specific pollution prevention plans and annual progress reports from a list of companies.
• The Department of Environmental Affairs provided the records requested in paragraphs 2.1, 2.2, 2.3, and 2.4 of the CER's application on 17 May 2019, following a communication of the outcome on 5 April 2019.
• The Department has deferred the release of annual progress reports submitted under the National Pollution Prevention Plan Regulations because the records may fall under section 47 of the Promotion of Access to Information Act, 2000 (PAIA), specifically potentially containing information within the scope of sections 36(1), 37(1), and 43(1).
• The Department has notified the companies listed in the request (the Third Parties) about the application in accordance with section 47 of PAIA, allowing them 21 days to make representations or provide consent for disclosure.
