A decision letter from the South African Department of Mineral Resources to the Centre for Environmental Rights regarding a request for access to information under the Promotion of Access to Information Act, 2000.

• The Department of Mineral Resources partially granted a request for access to information submitted by the Centre for Environmental Rights. Specifically, requests for records listed as 1.a, 1.b, 1.c, 1.d, 1.e and 1.g in part "D" of the application were granted, while records 1.f, 1.h, 1.i and 1.j were refused.
• The refusal of certain records was based on sections 36(1) and 44(1) of the Promotion of Access to Information Act, 2000. Section 36(1) relates to the protection of third-party trade secrets, financial, commercial, scientific, or technical information, and information supplied in confidence. Section 44(1) relates to the protection of opinions, advice, reports, recommendations, or accounts of consultations used to formulate policy or make decisions.
• The Deputy Information Officer notified the requester that internal appeals against the refusal can be lodged using a prescribed form under Section 74 of the Act. Additionally, the Regional Manager for Mineral Regulation in the Mpumalanga Region is responsible for advising on access fees, which must be paid before the granted documents are released.
