A letter from the South African Department of Environmental Affairs to the Centre for Environmental Rights regarding the Minister's decision on an appeal against the environmental authorisation for a 1200MW coal-fired power station proposed by Newshelf 1282 (Pty) Ltd.

• The Minister of Environmental Affairs dismissed the appeal against the amendment to the Environmental Authorisation (EA) for the establishment of a 1200MW coal-fired power station and associated infrastructure by Newshelf 1282 (Pty) Ltd, though the Minister did amend the EA by inserting conditions 10.5 and 10.6 and amending conditions 17.2.7, 17.5.4, and 17.6.1.
• Condition 10.5 of the amended authorisation requires the holder to conduct a climate change impact assessment before the project begins, with the process starting no later than six months from the date of the Appeal Decision; the resulting assessment and its recommendations must be submitted to the Department for review.
• Condition 10.6 requires a Palaeontological Impact Assessment Report (PIAR), prepared by a qualified palaeontologist based on a field assessment, to be submitted to the Department and the South African Heritage Resource Agency (SAHRA) within six months of the decision and prior to project commencement.
• The Department of Environmental Affairs clarifies that the Minister's requirement for the applicant to perform climate change and paleontological impact assessments within six months does not signify that the original decision to issue the Environmental Authorisation was unlawful.
