A letter from the South African Department of Environmental Affairs to the Centre for Environmental Rights responding to a Promotion of Access to Information Act (PAIA) request for greenhouse gas emission reports and pollution prevention plans.

• The Centre for Environmental Rights requested access to several records on 11 February 2019, including the database of data providers registered under Regulation 5 of the National Greenhouse Gas Emission Reporting Regulations, the database of persons who submitted pollution prevention plans under regulation 4(1) of the national pollution prevention plan regulations, and specific reports from various companies.
• The Chief Directorate: Climate Change Monitoring and Evaluation reported that it did not receive reports under Regulation 7(1) of the National Greenhouse Gas Emission Reporting Regulations, 2017 from Petmin Ltd, Mbuyelo Coal Pty Ltd, Kuyasa Mining Pty Ltd, Exxaro Resources Ltd, and Gold Fields Ltd.
• The Department of Environmental Affairs invoked Section 23(1) of PAIA to notify the requester that certain records could not be provided because they either cannot be found or do not exist, providing a supplementary affidavit in terms of section 23(1)(b)(ii) of PAIA.
