APPEAL IN TERMS OF SECTION 43(1A) OF THE NATIONAL ENVIROMENTAL MANAGEMENT ACT, 1998 AGAINST THE ENVIRONMENTAL AUTHORISATION GRANTED TO TETRA4 (PTY) LTD ON 21 May 2025 – [REFERENCE NO: 12/4/007]

The Centre for Environmental Rights, acting on behalf of MEJCON-SA and MACUA, has filed an appeal to the Minister of Forestry, Fisheries and Environmental Affairs to set aside an Environmental Authorisation granted to Tetra4 (Pty) Ltd by the Department of Mineral Resources and Energy.

• The Centre for Environmental Rights, representing appellants MEJCON-SA and MACUA, is appealing a decision dated 09 May 2025 by the Director-General of the Department of Mineral Resources and Energy (DMRE) which granted an Environmental Authorisation (EA) to Tetra4 (Pty) Ltd.
• The appeal is submitted under Section 43(1A) of the National Environmental Management Act, 1998, and follows the National Environmental Management National Appeal Regulations, 2014.
• The appellants received notification of the decision on 22 May 2025 and submitted the appeal within the required 20-day timeframe.
• The appeal submission includes detailed appeal submissions (Annexure A), supporting documentation (Annexure A1 and A2), an appeal response report form, and an appeal questionnaire.
• The appellants have requested that Tetra4 (Pty) and/or the Environmental Assessment Practitioner (EAP) provide contact information for interested and affected parties (I&APs) and organs of state, as the appellants do not possess these details.
