APPEAL IN TERMS OF SECTION 43(1A) OF THE NATIONAL ENVIROMENTAL MANAGEMENT ACT, 1998 AGAINST THE ENVIRONMENTAL AUTHORISATION GRANTED TO AFRO ENERGY (PTY) LTD ON 23 JUNE 2025 – [REFERENCE NO: 12/4/007]

The Centre for Environmental Rights, acting on behalf of FSEJN, has filed an appeal to the Minister of Forestry, Fisheries, and the Environment to set aside an Environmental Authorisation granted to Afro Energy (Pty) Ltd on 23 June 2025.

• The Centre for Environmental Rights and FSEJN are appealing a decision made by the Director-General of the Department of Mineral Resources and Energy (DMRE) on 23 June 2025, which granted an Environmental Authorisation (EA) to Afro Energy (Pty) Ltd under reference number 12/4/007.
• The appeal is submitted under Section 43(1A) of the National Environmental Management Act, 1998, and follows the National Environmental Management National Appeal Regulations, 2014. The appellants received notification of the decision on 07 July 2025 and submitted the appeal within the required 20-day timeframe.
• The appeal submission includes detailed appeal submissions (Annexure A), an appeal response report form outlining the grounds of appeal, and an appeal questionnaire.
• The appellants have requested that Afro Energy (Pty) or the Environmental Assessment Practitioner (EAP) provide contact details for interested and affected parties (I&APs) and organs of state, or forward the appeal to them, as the appellants do not possess this information.
