• The Centre for Environmental Rights (CER), representing the Highveld Environmental Justice Network (HEJN), groundWork (gW), and Earthlife Africa, Johannesburg (ELA), submitted formal comments on 27 May 2015 regarding the Nkangala District Municipality's (NDM) draft Air Quality Management Plan (AQMP) and Air Quality Management By-law.
• The CER and its clients expressed significant dissatisfaction with the stakeholder engagement process, citing unreasonably short notice for meetings and delays in providing draft documents. Specifically, for a meeting at Steve Tshwete Local Municipality, notice was provided only one-and-a-half days in advance, and drafts were only available the day before the meeting.
• The CER alleged that the Municipality's public notice failed to comply with section 21 of the Local Government Municipal Systems Act, 2000, because it did not provide a mechanism to assist persons who are unable to read or write in transcribing their comments.
• The CER views the AQMP and by-law as critical tools for improving air quality within the Highveld Priority Area (HPA), specifically for the regulation of industrial emissions, the reduction of poor air quality in dense low-income settlements, and the improvement of community health.
