A formal request from the law firm Webber Wentzel, acting for the Centre for Environmental Rights (CER), to the Department of Mineral Resources and Energy (DMRE) for the urgent delivery of the Record of Decision (ROD) regarding an appeal to extend mining operations at the Tormin mine.

• The Centre for Environmental Rights (CER) has lodged an appeal under section 96(1) of the Mineral and Petroleum Resources Development Act, 2002 (MPRDA) concerning a decision to "extend mining operations at the Tormin mine on the West Coast".
• Webber Wentzel, representing the CER, requested the Record of Decision (ROD) from the DMRE Regional Manager in accordance with Regulation 74(8) of the MPRDA Amendment Regulations, which requires the Regional Manager to send records pertaining to the decision to the appellant within 10 days of receiving the notice of appeal.
• The CER initially lodged the appeal electronically on 21 September 2020 and provided hard copies on 30 September 2020, later submitting a rectified appeal on 30 October 2020 to correct procedural defects.
• The request for the ROD is urgent because the Rights Holders submitted their answering affidavit on 30 September 2020, and the Amendment Regulations specify that an appellant should receive the ROD before submitting an amended notice of appeal or replying affidavit.
