FINAL DEADLINE EXTENSION - REQUEST FOR REASONS FOR THE AMENDMENT OF SUBCATEGORY 1.1: SOLID FUEL COMBUSTION INSTALLATIONS IN THE LISTED ACTIVITIES AND ASSOCIATED MINIMUM EMISSION STANDARDS

The Centre for Environmental Rights, representing groundWork and Earthlife Africa, has issued a final deadline of 25 June 2020 for the South African Department of Environment, Forestry and Fisheries to provide written reasons for doubling the 2020 sulphur dioxide (SO2) minimum emission standard (MES) limit for existing sub-category 1.1 solid-fuel combustion installations. The organization argues that this amendment weakens environmental protections and seeks the information to determine if High Court review proceedings are necessary.

• The Centre for Environmental Rights, acting for groundWork and Earthlife Africa, is demanding written reasons for the decision to amend the Listed Activities published under Government Notice No. 421, Gazette No. 43174 on 27 March 2020. This amendment is described as weakening the minimum emission standard (MES) for sulphur dioxide (SO2) for existing solid-fuel combustion installations by doubling the 2020 SO2 MES limit for existing sub-category 1.1 facilities.
• The request for reasons is based on section 5(1) of the Promotion of Administrative Justice Act 3 of 2000 (PAJA). Despite previous deadlines of 4 May 2020 and 31 May 2020, the Department of Environment, Forestry and Fisheries has not provided the written reasons.

• The Centre for Environmental Rights has set a final deadline of 25 June 2020 for the response. They specifically request that the response include a complete list of solid fuel combustion installations impacted by the amendment and specific references from the Department's media statement.
