TRUSTEES FOR THE TIME BEING OF THE GROUNDWORK TRUST / THE MINISTER OF MINERAL RESOURCES & ENERGY AND NERSA (CASE NO 32200/20)

A letter from the Centre for Environmental Rights (CER) proposing a settlement to withdraw a legal application brought by the Trustees for the Time Being of the GroundWork Trust against the Minister of Mineral Resources & Energy and NERSA regarding the Integrated Resource Plan for Electricity, 2019 (IRP).

• The Trustees for the Time Being of the GroundWork Trust initiated a legal application in July 2020 after failing to obtain reasons and technical evidence for decisions within the Integrated Resource Plan for Electricity, 2019 (IRP), which they had requested since November 2019.
• The first respondent (the Minister of Mineral Resources & Energy) provided reasons on 14 August 2020, but the applicant considers these reasons to be "inadequate and in certain respects contradictory."
• The second respondent (NERSA) has refused to provide any reasons for the decisions in question.
• The Centre for Environmental Rights proposes to withdraw the application on the condition that each party pays its own costs, citing the need to avoid protracted litigation and the expenditure of limited time and resources.
