PUBLIC HEARINGS IN RESPECT OF THE GENERATION LICENCE APPLICATIONS FOR THE PROPOSED KHANYISA AND THABAMETSI INDEPENDENT POWER PRODUCER COAL-FIRED POWER STATIONS

The Centre for Environmental Rights (CER) submitted a letter to the National Energy Regulator of South Africa (NERSA) on 6 March 2018, requesting procedural details for public hearings regarding generation licence applications for the proposed Khanyisa and Thabametsi coal-fired power stations.

• The Centre for Environmental Rights (CER) requested specific procedural information from NERSA regarding the public hearings scheduled for 27 March 2018, as the guidelines on NERSA's website lacked detail on how hearings are conducted. The CER sought clarification on the time allotted for public objections, whether applicants (Thabametsi Power Company (Pty) Ltd and ACWA Power Khanyisa Thermal Power Station RF (Pty) Ltd) could respond to objectors, and whether the hearings for each application would be conducted separately.
• The CER argued that holding the hearings exclusively at NERSA's offices in Pretoria effectively excludes affected community members from the public participation process. The CER urged NERSA to hold additional hearings in Lephalale for the Thabametsi application and in eMalahleni for the Khanyisa application to ensure the process is justifiable, transparent, inclusive, and fair, as required by the National Energy Regulator Act, 2004 and the Promotion of Administrative Justice Act, 2000.
• The CER requested information on whether NERSA's offices possess video conferencing facilities for remote participants and whether clients could submit supplementary written objections, noting that over a year had passed since the original written objections to the Thabametsi and Khanyisa applications were filed.
