OBJECTIONS TO GENERATION LICENCE APPLICATIONS FOR THABAMETSI AND KHANYISA IPP COAL-FIRED POWER STATIONS

The Centre for Environmental Rights (CER), representing Earthlife Africa and groundWork, submitted a formal letter to the National Energy Regulator of South Africa (NERSA) on 4 April 2018. The letter follows a public hearing held on 27 March 2018 regarding generation licence applications for the Thabametsi and Khanyisa coal-fired power stations, raising concerns about the hearing process and requesting further information on NERSA's procedural compliance.

• The Centre for Environmental Rights (CER) and its clients, Earthlife Africa and groundWork, have submitted both oral and written objections to the generation licence applications for the Thabametsi and Khanyisa coal-fired power stations, with supplementary written objections submitted on 26 March 2018.
• CER argues that NERSA is required to hold public hearings in the areas affected by the proposed power stations, citing rule 4(2)(a) of the NERSA Rules for Public Hearings. Specifically, CER requested confirmation on whether hearings will be held in Lephalale for the Thabametsi project and eMalahleni for the Khanyisa project.
• CER raised concerns regarding the composition of the hearing panel on 27 March 2018, noting that only one NERSA member, Mr Mkhize, presided over the proceedings. CER requested the names and positions of all committee members appointed to conduct the hearing and the identity of the appointed chairperson.
• CER requested access to the recordings or transcriptions of the 27 March 2018 hearing, citing rule 16 of the NERSA Rules for Public Hearings, and questioned whether other NERSA members would be required to consider these records.
