APPLICATION FOR CHANGE IN LAND-USE (IN TERMS OF REGULATION 18 OF THE SPLUM REGULATIONS), IN RESPECT OF PORTION 1 OF YZERMYN 96 HT, IN THE DR PIXLEY KA ISAKA SEME LOCAL MUNICIPALITY AND THE GERT SIBANDE DISTRICT MUNICIPALITY, MPUMALANGA

The Centre for Environmental Rights (CER) wrote to the Municipal Manager of the Dr Pixley Ka Isaka Seme Local Municipality on 15 March 2019 to request the status of a land-use change application for Portion 1 of Yzermyn 96 HT, following reports that a previous outcome was communicated erroneously.

• The Centre for Environmental Rights (CER) is representing a coalition including the Mining and Environmental Justice Community Network of South Africa (MEJCON-SA), groundWork, Earthlife Africa Johannesburg, Birdlife South Africa, Endangered Wildlife Trust, Federation for a Sustainable Environment, Association for Water and Rural Development (AWARD), and Bench Marks Foundation. On 29 January 2019, the CER submitted a petition to intervene in an appeal lodged by the Practice Group on behalf of Atha Africa Ventures (Pty) Ltd.
• A communication dated 30 November 2018 regarding the change of land use over Portion 1 of the farm Yzermyn 96 was reportedly communicated to the applicant, Atha-Africa, in error. The Practice Group stated that the Municipality informed them telephonically that the outcome was not an official decision of the Tribunal and that the matter would be submitted to the Municipal Planning Tribunal for a hearing.
• As of 15 March 2019, the CER had received no further communication from the Municipal Manager's office or the Practice Group and requested an update on the status of the land use change application, the Practice Group's appeal, and the CER's petition to intervene.
