DECISION ON THE APPEAL OF THE ENVIRONMENTAL AUTHORISATION GRANTED TO NEWSHELF 1282 (PTY) LTD FOR THE PROPOSED THABAMETSI POWER STATION

A letter from the Centre for Environmental Rights to the Minister of Environmental Affairs seeking legal clarification on the potential amendment or revocation of the environmental authorisation for the Thabametsi Power Station following required impact assessments.

• The Minister of Environmental Affairs issued an appeal decision on 7 March 2016 that upheld the integrated environmental authorisation (EA) for Newshelf 1282 (Pty) Ltd (now Thabametsi Power Project (Pty) Ltd), but added conditions requiring a paleontological impact assessment report (PIAR) and a climate change impact assessment (CCIA) to be completed within 6 months.
• The Appeals Directorate informed the Centre for Environmental Rights that the CCIA and PIAR would be referred to the Department of Environmental Affairs, which may then decide to revoke or amend the EA based on the assessments' findings.
• The Centre for Environmental Rights has requested the Minister clarify the legal provisions within the National Environmental Management Act, 1998 or other laws that allow the Department to amend or revoke the EA, as well as the procedures that would be followed to make such a determination.
