UPDATE ON THE PREFERRED BIDDERS UNDER THE FIRST BID WINDOW OF THE COAL BASELOAD IPP PROCUREMENT PROGRAMME (THE PROPOSED THABAMETSI & KHANYISA COAL-FIRED POWER STATION) & STATUS OF ANY FUTURE BID WINDOWS

The Centre for Environmental Rights notified the IPP Office that the Department of Environment, Forestry and Fisheries confirmed the environmental authorisation for the Khanyisa coal-fired power station expired on 31 October 2018 due to ACWA's failure to meet required conditions.

• The Department of Environment, Forestry and Fisheries (DEFF) confirmed on 20 September 2019 and again on 6 December 2019 that the environmental authorisation (EA) for the proposed Khanyisa independent power plant (IPP) coal-fired power station expired on 31 October 2018.
• The DEFF determined that ACWA's commencement of activities listed in the EA was unlawful because the company failed to fulfill peremptory conditions prior to starting those activities. Because these conditions were suspensive, the unlawful commencement did not prevent the EA from lapsing.
• Independent verification by Department officials concluded that certain EA conditions were not met, and ACWA failed to apply for an extension of the EA's validity in a timely manner.
• The Centre for Environmental Rights asserts that the expiration of the Khanyisa project's EA by operation of law has significant implications for the project's future and its participation in the coal baseload IPP programme managed by the Department of Mineral Resources and Energy (DMRE).
