THE DEVELOPMENT BANK OF SOUTHERN AFRICA’S ROLE IN FINANCING PROPOSED NEW COAL-FIRED POWER PLANTS

A letter from the Centre for Environmental Rights to the Development Bank of Southern Africa (DBSA) requesting transparency and legal reasons regarding the potential financing of the Thabametsi and Khanyisa coal-fired power plants.

• The Centre for Environmental Rights has requested that the Development Bank of Southern Africa (DBSA) clarify the decision-making process, including funding status, steps remaining, and timeframes, for the proposed Thabametsi and Khanyisa coal-fired power plants.
• The Centre for Environmental Rights requested written reasons for any decisions to finance the Thabametsi and/or Khanyisa plants under section 5 of the Promotion of Administrative Justice Act, 2000 (PAJA).
• The DBSA has refused to provide reasons for funding decisions, arguing that such decisions do not constitute administrative action under PAJA, although the DBSA has not disputed its status as an organ of state.
• The Centre for Environmental Rights disputes the DBSA's refusal to respond, citing the bank's mandate to promote sustainable development projects.
